Legal Updates for New University of Georgia Students
As students at the University of Georgia get settled into their routine of fall semester, it is important to remember that there is a large new group of students in Athens, Georgia unfamiliar with the legal landscape of Athens. Until July of this year, in Athens there were no citations issued for Underage Possession of Alcohol (MIP), but individuals instead were arrested and taken to the Athens-Clarke County jail. However, the legislature changed the law to require police officers to issue a citation for the offense instead of making an arrest unless there is some other illegal action committed by the person. However, the prosecutor in the Municipal Court and State Court of Clarke County is still handling their prosecution of these Underage Possession of Alcohol citations the same way they were before the change in law.
DUI enforcement is not only aggressively pursued by the police, but is determinedly prosecuted by the State, which is represented by the Solicitor General in the Municipal Court of Athens-Clarke County and the State Court of Athens-Clarke County. The prosecutor pursues stiff sanctions for DUI offenses, especially for multiple DUI offenders. When an individual is arrested for DUI, time is of the essence because of license implications that individuals face. These license implications often times can be harsher for people under the age of 21.
